5. How We May Respond to a Complaint

After receiving a sufficiently detailed copyright complaint, JML Pets may review the information provided and take steps appropriate to the circumstances.

  • Contact a relevant supplier, licensor, user, or content provider

6. Good-Faith Complaints

7. DMCA Notices Where Applicable

The Digital Millennium Copyright Act is legislation of the United States.

The statutory requirements for a DMCA notification are established by U.S. law and may differ from the requirements for an ordinary UK copyright complaint.

8. DMCA Designated Agent

Certain protections available to qualifying online service providers under 17 U.S.C. §512 involve additional requirements, including requirements concerning a designated agent.

This policy does not, by itself, represent that JML Pets has registered the contact details listed above as a designated agent with the United States Copyright Office.

Where a registered DMCA designated agent is legally required and applicable, the relevant current agent information should be determined from the applicable official registration records.

9. Counter-Notices Under the DMCA

  • The location where the material appeared before it was removed or disabled

  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification

  • Your name

  • Your address

  • Your telephone number

  • The jurisdiction and service-of-process statements required by 17 U.S.C. §512

The jurisdiction statement required by the U.S. DMCA concerns the applicable United States Federal District Court. It is not a statement consenting to the exclusive jurisdiction of the courts of England and Wales.

10. Restoration Following a DMCA Counter-Notice

Where the DMCA notice-and-counter-notice procedure legally applies and all statutory requirements have been satisfied, material may be restored in accordance with the timetable and conditions established under 17 U.S.C. §512.

Under that procedure, restoration generally occurs no fewer than 10 and no more than 14 business days after receipt of a valid counter-notification unless the original complainant provides notice that qualifying court proceedings have been commenced.

This process applies only where the relevant U.S. statutory requirements apply to the situation.

11. User-Submitted Content

If JMLPets.co.uk provides functionality that allows customers or other users to submit content, such as:
